Fair Credit Reporting Act (FCRA) Notice

Texas-Arrests.org is not a Consumer Reporting Agency (CRA) as defined by the FCRA. The information published on this website cannot be used for employment screening, tenant screening, credit decisions, insurance underwriting, or any other FCRA-regulated purpose.

1. Digital Millennium Copyright Act (DMCA) Notice

Texas-Arrests.org respects the intellectual property rights of others and strictly complies with the provisions of the DMCA, 17 U.S.C. § 512. If you are a copyright owner (or an authorized agent) and believe that any content hosted on this website infringes upon your copyrighted work, you may submit a formal takedown request.

What constitutes a valid DMCA claim?

DMCA claims only apply to copyrighted creative works (e.g., a photograph you took, an original article you wrote). Public government records and police-issued booking photos (mugshots) are generally in the public domain or owned by the issuing law enforcement agency, not the individual pictured.

How to Submit a DMCA Takedown Notice

To process your request, your written communication must include all of the following:

  1. A physical or electronic signature of a person authorized to act on behalf of the copyright owner.
  2. Identification of the copyrighted work claimed to have been infringed.
  3. Identification of the material that is claimed to be infringing, including the exact URL(s) where the content is located.
  4. Information reasonably sufficient to permit us to contact you, such as your legal name, address, telephone number, and email address.
  5. A statement that you have a good-faith belief that use of the material is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner.

Warning: Under 17 U.S.C. § 512(f), any person who knowingly misrepresents that material is infringing may be subject to severe civil penalties and damages.

2. Public Record & Mugshot Removal Requests

Unlike copyright claims, arrest records and mugshots are matters of public record. While the First Amendment protects the publication of truthful, publicly available government data, Texas-Arrests.org operates ethically and offers a Courtesy Removal Program for individuals whose legal circumstances have changed.

Qualifying Criteria for Courtesy Removal

We will manually review and redact/remove pages if you provide official documentation proving one of the following:

✔️ Expungement or Sealed Record

The court has officially ordered your criminal record to be expunged, sealed, or destroyed under Texas law.

✔️ Non-Disclosure Order

You have been granted an Order of Nondisclosure, restricting public access to your deferred adjudication.

✔️ Acquittal or Dismissal

The charges were formally dropped, dismissed by the prosecutor, or you were found not guilty in a court of law.

✔️ Identity Theft / Misidentification

You were falsely arrested due to stolen identity, or the government agency published factually incorrect identifying data.

Required Documentation for Removal

Because we must protect the integrity of the data against fraudulent removal requests, you must submit proof. Please email us the following:

  • Your full legal name (as it appears on the record).
  • The exact URL(s) on Texas-Arrests.org that you are requesting be reviewed.
  • A copy of your government-issued ID (you may blur your ID number and address for privacy; we only need to verify your name and face).
  • Official Court Documentation: A scanned copy of the judge’s expungement order, dismissal paperwork, or non-disclosure order.

Note: We never charge fees for updating or removing records. We do not participate in “pay-to-remove” extortion schemes.

3. Processing Time & Expectations

All content on Texas-Arrests.org is managed by a real editorial team, not automated bots. Therefore:

  • Review Period: Valid DMCA and public record removal requests are typically reviewed within 7 to 14 business days.
  • Verification: We reserve the right to verify court documents with the originating Texas county clerk before executing a removal.
  • Search Engines: Once we remove a page from our servers, it may still appear in Google or Bing search results for a few weeks until their crawlers update. We cannot control Google’s cache. You may use the Google Outdated Content Tool to speed up that process.
